
Identity Theft Can Happen To You!
My wife JoAnn and I were living a comfortable life in the
Mid-West when my identity was stolen. I was the victim of a career
criminal who befriended my mother and learned the details of my life. This
allowed the criminal to assume my identity in order to continue his criminal
activities. He did this by charging over $100,000 in my name and ruining
my credit. We decided to take a negative situation and make it a
positive. The first positive step we took was to get the criminal
arrested, convicted, and imprisoned for crimes unrelated to the Identity Theft
he perpetrated on me. We had to get him imprisoned on unrelated charges
because there were no laws in Arizona that made stealing someone's identity a
crime.
After moving back to Arizona where I was raised, we took
another positive step. I authored the Arizona State Law making it a felony
to steal someone's identity. We presented this law to Arizona State
Senator Tom Smith, who helped us get the law passed and signed by the governor
in 1996. The Arizona law was the first of its kind in the nation.
The next positive step we took was contacting Senator Jon
Kyl of Arizona. He immediately saw a need for a federal felony law against
Identity Theft, based on the Arizona state law. He worked endlessly to
help us get the new federal law passed unanimously through the United States
Senate. In the House of Representatives, Congressman John Shadegg of
Arizona also worked endlessly to help us get the federal felony law passed and
to the president, who signed the bill into law in October, 1998.
One of the key points in both laws is that now the victims
of Identity Theft are allowed to seek restitution in court.
My wife, JoAnn, and I have helped hundreds of victims of
Identity Theft throughout the United States. We have even helped law
enforcement personnel help other victims. While helping others combat
Identity Theft, we have learned a great deal about the law and the problems that
victims face when criminals use their names for illegal purposes. To share
our knowledge more efficiently, JoAnn and I have written "IDENTITY THEFT:
